According to the legal community on the 25th, the Seoul Central District Court recently ruled against Mr. A in a lawsuit to cancel ownership registration against his half-brother Mr. B and his wife. The ,,, case originated from an apartment in Gangnam-gu, Seoul. Mr. A's father married his first spouse in 1968 and had two children. After his spouse's death, he remarried in 1978 and had Mr. B, but his second spouse also passed away in 2018, and his father died in September last year.  In 2022, while he was still alive, the father left a wish to bequeath half of the shares in this apartment—effectively his only assets—to Mr. B and his spouse. The market value of the apartment was 2.786 billion won according to Mr. B's claim, and 3.3 billion won according to Mr. A's side. In response, Mr. A filed a lawsuit against Mr. B and his wife, claiming that his minimum reserved portion had been infringed, seeking the return of 350 million won. However, the court recognized that Mr. B and his wife had supported his father for a long time and contributed substantially to the apartment's development, and thus excluded them from the statutory reserved portion calculation. Since 2016 at the latest, Mr. and Mrs. B have lived close to his father, accompanying him during his hospital outpatient visits and hospitalizations for various diseases such as stomach cancer, and have been providing care. It is said that Mr. B and his wife also played a role in securing the apartment. The father won the apartment through a special allocation for children of national merit recipients, and the court determined that Mr. and Mrs. B led the subscription and raised most of the proceeds. On the other hand, Mr. A stated that he had effectively cut off contact since his father remarried in 1978, and it was determined that he had stopped contacting him since around 2016 at the latest,,, The claim for the child's reserved portion after the contact was not accepted.
